Have you seen a change in your Maintenance payment or Child Maintenance payments, if these were agreed outside of CMS?

Please remember, there is an element of risk in everything, and nothing is guaranteed.

The question is: why has that person not paid, and why do they need an uplift? What has changed to cause this?

Whether it is a variation up or down (or a suspension of payment), there must be a cogent argument that is followed up by evidence.

It is all very well to make the application, but this needs to ‘have legs.’ Please consider all the facts, otherwise it could become a very expensive experience.

Rushing to court may seem exciting, but please make sure your reasoning is sound.

It is better to be told, ‘no’, and save money, than to be told, ‘yes’, when everything is exciting, only to find that you should have taken some time to form a view: never rush into an application and remember, you are the client!
